Buyer wants to represent themselves on a transaction, is there a form to be signed so that the Listing Agent is covered?

Yes, in Florida there is now a required written buyer representation agreement that must be executed before a licensed agent can show property to a buyer, which is a significant change stemming from the 2024 NAR settlement. In Brooksville, Hernando County, Florida, this form clarifies the scope of representation, the compensation structure, and the obligations of both the buyer and the agent before any property tours take place. If a buyer chooses to represent themselves without an agent, they are acting as an unrepresented party, and the listing agent represents only the seller in that transaction. The listing agent is not permitted to give the unrepresented buyer advice that serves their interest over the seller interest, so buyers going this route should understand they are navigating the contract process alone. Florida real estate contracts involve inspection periods, title contingencies, and financing clauses that carry real legal and financial consequences, so proceeding without representation is a meaningful decision. Knowing exactly what you are signing and who is working for whom protects everyone in the transaction. Kevin Neely & Kaitlynd Robbins | K2 Sells, Keller Williams Elite Partners

Yes. Most states require a “No Brokerage Relationship” or “Buyer Acknowledgment” form that confirms the buyer understands they’re not represented by an agent. It protects both parties and clarifies that the agent owes no fiduciary duties to the buyer.

Everything in a real estate transaction should be in writing and agreed upon by signing & dating by both parties in the transaction. What should be listed is -- what will be done, by whom, by when and who will pay. This covers both parties. Talk to your listing agent and/or your attny.

Not sure if there is an official form from NAR, however I have used this one. Email me if you would like a copy of mine. It reads " Unrepresented Buyer Form Property _________________ NOTICE: A buyer is not required to have professional representation to purchase real estate. Broker Commissions are not set by law and are fully negotiable. Prospective Buyer(s) “Buyer” hereby declares that they do not have professional representation and have not entered into a representation agreement. Prospective Buyer acknowledges the Agent is allocating time and resources and performing Broker Duties to facilitate the showing of the Property, and therefore should the Buyer choose to elect representation then Buyer shall be represented by Agent’s brokerage for the purchase of the Property. Prospective Buyer hereby acknowledges, understands, and agrees with terms on this document." Followed by signatures Hope this helps

I would consult your broker. Brokerages may have their own forms for this and can guide you through the process of what you can and can not do. This is usually only done if the buyer is an agent, or an attorney.
